Privacy Policy
Effective October 18, 2026
This policy explains what personal information Duskwell collects when you visit our website, buy from us or contact us, how we use it, who we share it with, and the choices you have. "Duskwell", "we" and "us" means Duskwell Sleep Care, based in North Carolina, United States. Our store runs on Shopify.
Information we collect
Information you give us
- Order and contact details — your name, email address, shipping and billing address and phone number when you place an order or create an account.
- Payment information — entered at checkout and processed by Shopify and the payment providers shown there. We see the card type and last four digits, not the full card number.
- Subscription details — the products, frequency, next billing date and payment method reference for any refill subscription, held through the Shopify Subscriptions app. When you subscribe we also record the subscription terms you agreed to on your order.
- Messages — what you send us by email, through our contact form, or in live chat.
- Reviews — the rating, text, photos and display name you submit in a product review.
- Email signup — your email address and the fact that you agreed to receive marketing emails.
- Sleep quiz answers — your answers are kept in your own browser so the site can show your recommendations and "sleep profile". They are not sent to us. If you go on to place an order, the name of your sleep profile (for example "The Light Sleeper") is attached to that order so we can see which recommendations are useful. We do not ask for, and the quiz does not collect, any medical history or diagnoses.
Information collected automatically
- Device and usage information — your IP address, browser and device type, approximate location derived from your IP address, the pages you view, what you add to your cart, and how you arrived at the site. This is collected through cookies and similar technologies described in our Cookie Policy, subject to the choices you make in our cookie banner.
Information from others
- Delivery updates — tracking and delivery status from our fulfilment partners and carriers.
- Fraud and payment checks — results from Shopify and payment providers about whether a transaction looks fraudulent.
How we use it
- To take, fulfil, ship and track your orders and subscriptions, including sending order, shipping and subscription emails.
- To process returns, refunds and replacements, and to answer your questions.
- To run your account and remember your choices.
- To send marketing emails if you have agreed to receive them.
- To understand how the site is used and improve it, where you have allowed analytics cookies or where the law permits this without consent.
- To prevent fraud, keep the site secure, and enforce our terms.
- To meet legal, tax and accounting obligations, and to deal with disputes and chargebacks.
We do not use your information to make decisions about you that have legal or similarly significant effects solely by automated means.
Who we share it with
We share personal information only with the service providers we need to run the store, and only what they need for their part:
- Shopify — hosts our store, checkout, customer accounts and order records, processes payments through Shopify Payments where used, provides our email tools and store analytics, and runs Shopify Subscriptions for refill subscriptions.
- Payment providers shown at checkout (for example PayPal or digital wallets), when you choose them.
- DSers and our manufacturing partners — to fulfil your order we pass your name, shipping address, phone number and the items ordered to our order-management app (DSers) and to the supplier who makes and ships the product. Our suppliers are located outside the United States.
- Shipping carriers — your name, address and phone number, to deliver your parcel.
- Tidio — provides our live chat, if you allow it in your cookie choices. It processes your chat messages and the pages you are on during a chat.
- Judge.me — runs our product reviews and may email you after a purchase asking for a review. It receives your name, email and order details for that purpose.
- Professional advisers and authorities — where needed to comply with the law, respond to valid legal requests, or protect our rights, our customers or others.
- A buyer of our business — if Duskwell is sold or merged, customer information may be transferred as part of that deal, subject to this policy.
We do not sell your personal information for money, and we do not share it with other companies for their own marketing.
Advertising. We do not currently run third-party advertising pixels or tags (such as Meta, Google Ads or TikTok) on this site. If we add one, we will update this policy and our Cookie Policy first, and it will only run if you allow marketing cookies. Some state privacy laws define "selling" and "sharing" broadly enough to cover certain advertising and analytics; you can opt out of any such activity at any time on our Your Privacy Choices page.
Shopify's own processing. Shopify also uses some information about your activity across Shopify stores for its own purposes, such as fraud prevention and its shopping services, as described in the Shopify Consumer Privacy Policy. You can exercise rights over that processing through the Shopify Privacy Portal.
Cookies and your choices
We use cookies and similar technologies as explained in our Cookie Policy. When you first visit, our banner lets you accept all, reject non-essential, or choose by category. You can change your choice at any time from Cookie preferences at the bottom of every page.
If your browser sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of any sale or sharing of your personal information for that browser and, where we can link it, your account. We do not respond to other "Do Not Track" signals.
Marketing emails and texts
We only send marketing emails if you signed up for them. Every marketing email includes an unsubscribe link, and you can also email us to stop them. Unsubscribing does not stop emails about your orders, subscription or account, which we need to send.
Agreeing to receive order updates is not agreement to receive marketing. We do not currently send marketing text messages. If we start, we will ask for your separate, express consent first, and every text will explain how to opt out.
How long we keep information
- Orders, payments and refunds — for as long as we need them for tax, accounting and legal purposes, generally up to 7 years after the order.
- Subscription records and the terms you agreed to — for the life of the subscription and at least 3 years after you agreed to them, or 1 year after the subscription ends if later, so we can show what was agreed.
- Customer service emails and chats — up to 2 years after our last contact with you, unless they relate to an open dispute or safety issue.
- Marketing list — until you unsubscribe. We then keep only your email address on a suppression list so we do not email you again.
- Accounts — until you ask us to delete your account, subject to the order records above.
- Quiz answers and other choices stored in your browser — until you clear them, reset your sleep profile, or clear your browser storage.
Security
We use Shopify's secure platform, which encrypts checkout and is certified to the Payment Card Industry Data Security Standard. We limit who can access customer information to the people and providers who need it. No method of storing or sending information is completely secure, so we cannot guarantee absolute security. If we become aware of a breach that affects your information, we will notify you where the law requires.
Your rights
Depending on where you live, privacy laws may give you rights over your personal information. Whether or not a law requires it, we will honour the following requests from any customer:
- Access — ask what personal information we hold about you and get a copy.
- Correction — ask us to fix information that is wrong.
- Deletion — ask us to delete your information, except what we must keep for legal, tax, security or dispute reasons.
- Opt out — of marketing emails, and of any sale, sharing or targeted advertising.
- Appeal — if we decline your request, you can ask us to reconsider by replying to our decision. If you are still unhappy, you can contact your state attorney general.
To make a request, email sleepduskwell@gmail.com with the subject "Privacy request", or use the Shopify Privacy Portal. We will confirm we received it within 10 business days and respond within 45 days. If we need more time, we will tell you why. To protect you, we will verify your identity, usually by asking you to confirm details from your order or account. You can use an authorized agent, but we may ask for proof that you authorized them.
We will not treat you differently or charge you more for exercising these rights.
Children
Our store is for adults. It is not directed at children under 13 and we do not knowingly collect information from them. We do not knowingly sell or share the personal information of anyone under 16. If you believe a child has given us information, contact us and we will delete it.
Where information is processed
We are based in the United States and sell only to US addresses. Our service providers may process information in other countries, and our manufacturing partners who fulfil orders are located outside the United States. When information is transferred, it is protected as described in this policy and by our providers' own safeguards.
Changes to this policy
We will post any changes here with a new effective date. If a change materially affects how we use information we already hold, we will tell you by email or with a notice on the site before it takes effect.
